S.Africa's Barloworld boosts H1 profit, Russia unit robust

JOHANNESBURG (Reuters) - South African industrial group Barloworld Ltd boosted first-half profit by a third on Monday, as a solid result in its Russian mining equipment business offset slack demand at home.

Barloworld, which also sells cars and forklifts, said headline earnings per share totalled 321 cents in the six months to end-March compared with 245 cents a year earlier.

Headline EPS, the primary measure of profit in South Africa, strips out certain one-off items.

Barloworld, the biggest dealer of Caterpillar earth-moving equipment in southern Africa, is a barometer for the health of the region's vast mining industry.

Mining companies in South Africa have been forced to scale back capital expenditure due to faltering commodity prices and wildcat strikes.

Barloworld said revenue rose 11 percent to 31.3 billion rand helped also by strong sales of Bucyrus heavy-duty equipment.

The company paid $165 million for rights to Caterpillar's Bucyrus business -- whose products include trucks and loaders used in mining -- in South Africa, Botswana and Russia.

Shares in Barloworld have gained about 8 percent so far this year largely in line with a 6 percent gain on the All-share index

Hatch, Schumer Reach Deal on High-Skilled Workers in Immigration Bill

Sens. Chuck Schumer, D-N.Y., and Orrin Hatch have reached a deal on visas for high-skilled workers that should ensure the Utah Republican's vote for the immigration bill in committee.

An aide to Hatch said the senator was still awaiting final language on the deal before signing off on the agreement, but the deal reached with Democrats accepts most of his conditions for supporting the bill in committee. He has said he has other finance-related amendments he intends to offer on the floor that will need to pass for his continued support.

According to another aide, the deal came together in the minutes before the beginning of Tuesday?s markup, which Senate Judiciary Committee Chairman Patrick Leahy, D-Vt., says could conclude as early as today. Just an hour before the markup began, Sen. Dick Durbin, D-Ill., told?National Journal?the Gang of Eight was still working to reach a deal with Hatch.

Hatch had offered several provisions related to the number of visas for skilled workers as well as the high-tech community?s ability to access them. The amendments put him at odds with Durbin, a Gang member who was concerned the program would put American workers at a disadvantage.

The agreement, details of which were shared with?National Journal?by an aide familiar with the agreement, accepts several of Hatch?s amendments with some additional protections built in for American workers. For example, the agreement accepts the Utah senator?s amendment that determines the formula for increasing H-1B visas based on employer application levels, but the new modified version bars any increases if the unemployment rate in the affected professions is above 4.5 percent in the previous year.

It also narrows the requirement that employers offer a position to an ?equally qualified? U.S. worker to H-1B dependent employers. ?

A source close to the negotiations said the amendments could be formally offered in committee this afternoon.

At least one dead after Tornadoes rip through Plains, Midwest

NEW YORK (Reuters) - A tornado half a mile wide struck near Oklahoma City on Sunday, part of a massive storm front that hammered the central United States. News reports said at least one person had died.

By early Sunday evening, 19 tornados had touched down in parts of Iowa, Oklahoma and Kansas, according to the National Weather Service and local news reports.

Fox News reported that one person was killed in Shawnee, Oklahoma, east of Oklahoma City.

Police in Shawnee could not immediately be reached to confirm the report.

Officials of the National Weather Service in Oklahoma issued a series of increasingly urgent warnings in the late afternoon and evening, including an alert on Twitter about a tornado striking Pink, a town on the edge of Oklahoma City.

"Large tornado west of Pink!" the post read. "Take cover RIGHT NOW in Pink! DO NOT WAIT!"

An extreme weather system stretching from north Texas to Minnesota had been building for hours on Sunday when a "large tornado" touched down near Wichita, Kansas at 3:45 pm Central Standard time, according to a weather service alert.

Another alert warned of the likelihood of "exceptionally powerful, severe thunderstorms capable of destructive hail as large as baseballs," especially over southeast Kansas in the evening.

Kansas, Missouri, Oklahoma, Nebraska and Iowa are all in the path of the storm system capable of producing winds of up to 80 miles per hour, large hail stones and violent tornadoes.

The storm prompted an unusually blunt warning from the central region of the National Weather Service, which covers 14 states.

"You could be killed if not underground or in a tornado shelter," it said. "Complete destruction of neighborhoods, businesses and vehicles will occur. Flying debris will be deadly to people and animals."

A tornado also touched down in southwest Wichita at 3:45 p.m. Central time, moving northeast at about 35 miles per hour toward Topeka, said Pat Slattery, spokesman for the National Weather Service for the U.S. Central region.

In northeast Oklahoma, the Lincoln County sheriff's office reported three tornado touchdowns in that region, NBC News said reported early on Sunday evening.

Slattery said the potential severity of the storm prompted the weather service to issue the stark advisory, which is part of a new warning system being tested in the U.S. Central region after a violent tornado that struck Joplin, Missouri on May 22, 2011, killing 158 people and injuring hundreds.

Slattery said the new advisory was reserved for severe tornadoes with the potential to form into "supercell" storms, which produce powerful winds and flash flooding. Supercells are considered to be the most dangerous of four categories of storms because of the extreme weather they generate.

A recent National Oceanic and Atmospheric Administration assessment of the Joplin storm found that "when people heard the first tornado warning, they did not immediately seek shelter. They looked for a secondary source to confirm the tornado," Slattery said. "That got some people killed."

Russian TV: American accused of spying flies out

MOSCOW (AP) ? The U.S. Embassy employee accused of spying in Moscow flew out of Russia on Sunday, five days after he was ordered to leave the country, NTV television reported.

The Kremlin-loyal TV station broadcast video Sunday evening showing Ryan Fogle going through passport control and security at Sheremetyevo International Airport. He also was pictured in the company of embassy staff as he wheeled a suitcase into the Moscow airport, which is used by Delta Air Lines for its direct flights to New York.

Russian security services announced Tuesday that Fogle, a 29-year-old third secretary in the U.S. Embassy, had been caught trying to recruit a Russian counterterrorism officer. Fogle, who was accused of working for the CIA, was widely shown on Russian television wearing a blond wig.

The U.S. Embassy on Sunday again refused to comment on the case.

The attention given to the Fogle case in Russia contrasts with recent moves by Washington and Moscow to develop closer cooperation on counterterrorism in the wake of the Boston Marathon bombing on April 15.

The bombing suspects ? Dzhokhar Tsarnaev and his elder brother, Tamerlan, who was killed by police ? have roots in the Russian republic of Chechnya. Tamerlan spent six months last year in neighboring Dagestan, now the center of an Islamic insurgency, and U.S. investigators have been working with the Russians to try to determine whether he had established any contacts with the militants.

Little is known publicly about Fogle's duties and activities in Russia.

The U.S. State Department confirmed that Fogle worked as an embassy employee but would give no details about his job. The CIA declined comment.

Considering the season will all be available the day it premieres, it sounds pretty perfect for a marathon viewing.

What To Know: Based on a popular British reality competition, this new Jeff Foxworthy-hosted show features 10 home cooks vying for the title of best amateur baker in America, as well as a contract to publish their own cookbook and a $250,000 grand prize. Not bad for a couple of pies work, huh?

"Melissa & Joey" (ABC Family)

Season 3 premieres Wed., May 29 at 8 p.m. ET. Where We Left Off: Joe married Russian businesswoman Elena, but then she received a call that prompted her to fly back to Russia to testify for one of her innocent colleagues. The Season 2 finale ended with Mel -- who officiated the wedding -- and Joe toasting to the next "Mrs. Longo," wherever she may be.

Season 2 premieres Wed., March 29 at 8:30 p.m. ET. Where We Left Off: Ben and Riley's friend Katie faced some major drama when they found themselves in bed together after a night of partying. "Dancing Fools" (ABC Family)

What To Know: The half-hour comedy clip show, hosted by "Baby Daddy" star Melissa Peterman, features the funniest, most outrageous and memorable dances caught on camera. "The Killing" (AMC)

Season 3 premieres Sun., June 2 at 9 p.m. ET. Where We Left Off: Season 2 ended with Rosie Larsen's Aunt Terry being arrested for her murder. Detectives Linden (Mireille Enos) and Holder (Joel Kinnaman) got a call about a new case, but Linden wanted no part of it. Season 3 picks up a year later, with Holder searching for a runaway girl and discovering a string of murders connected to one of Linden's old cases. Though Linden is no longer a detective, she inevitably gets pulled back in.

Series premieres Sun., June 2 at 9 p.m. ET. What To Know: The reality series follows six college-educated women from affluent areas of Long Island who are still living with their families.

And as the title suggests, some of them are flirting with disaster and becoming mistresses themselves.

Series premieres Mon., June 3 at 9 p.m. ET. What To Know: This new one-hour drama from executive producer Jennifer Lopez follows a multi-ethnic, blended family, being raised by two working moms, as they welcome another troubled child into their home.

Where We Left Off: At the end of last season, Allison broke up with Scott, Peter warned Isaac and Derek that a new pack made up entirely of Alpha werewolves was coming, and said Alphas trapped Boyd and Erica in the woods, leaving viewers uncertain of their fate. Season 3 will pick up four months later, and focus on the introduction of the Alpha pack and the havoc they wreak.

Michael later incapacitated Riley and got her to agree to confess. Then, Fiona, Madeline, Sam and Jesse were released from their prison cells. Michael explained he "did what [he] had to do," but Fiona corrected him, saying, "You did what you wanted to do."

"Graceland" premieres Thurs., June 6 at 10 p.m. ET. What To Know: This cop drama, starring Daniel Sunjata and Aaron Tveit, follows a special group of law enforcement agents from the FBI, the DEA and U.S. Customs who all live under the same roof in sunny Southern California. Like frat guys (and girls), but with badges.

"The Hero" (TNT)

Series premieres Thurs., June 6 at 8 p.m. ET. What To Know: Dwayne "The Rock" Johnson is producing this competition series to test the strength, courage and integrity of a diverse group of nine individuals. Each week, the contestants will be challenged physically, mentally and morally as they try to prove that they truly deserve the title of "The Hero" and the life-changing grand prize that goes with it.

"72 Hours" (TNT)

Series premieres Thurs., June 6 at 9 p.m. ET. What To Know: Contestants on this "Survivor"-esque reality show are dropped into the wilderness with only a bottle of water and a GPS device on a mission to find a briefcase filled with $100,000.

Season 3 will explore whether the new alien is on the side of the humans or has another dark purpose in mind. We'll also learn what happened to Hal while he was unconscious, and what that might mean for the rebellion.

Jury gets first glimpse of defense in Jackson case

LOS ANGELES (AP) ? A look at key moments this past week in the wrongful death trial in Los Angeles between Michael Jackson's mother, Katherine Jackson, and concert giant AEG Live LLC, and what is expected at court in the week ahead:

THE CASE

Jackson's mother wants a jury to determine that the promoter of Jackson's planned comeback concerts didn't properly investigate Dr. Conrad Murray, who a criminal jury convicted of involuntary manslaughter for Jackson's June 2009 death. AEG's attorney says the case is about personal choice, namely Jackson's decision to have Murray serve as his doctor and give him doses of a powerful anesthetic as a sleep aid. Millions, possibly billions, of dollars are at stake.

WHAT HAPPENED

? Jurors heard from AEG Live's first two witnesses, a pair of choreographers who worked on Jackson's ill-fated "This Is It" shows. Stacy Walker told the panel she never saw any signs Jackson was impaired or ill during rehearsals. Her colleague Travis Payne, who rehearsed one-on-one with Jackson, acknowledged he couldn't say how many times the pair actually rehearsed and said he was concerned the singer was under the influence of prescription medications in the weeks before his death.

? An AEG accounting executive testified about the budget for "This Is It," which was planning on paying Murray up to $1.5 million for the first few months of the shows. The former cardiologist was never paid because Jackson died before signing his contract.

Colorado sheriffs sue over new gun restrictions

DENVER (AP) ? Colorado sheriffs upset with gun restrictions adopted in the aftermath of last year's mass shootings filed a federal lawsuit Friday, challenging the regulations as unconstitutional.

The lawsuit involves sheriffs from 54 of Colorado's 64 counties, most representing rural, gun-friendly areas of the state.

The sheriffs say the new state laws violate Second Amendment protections that guarantee the right to keep and bear arms. Opponents are criticizing the lawsuit as political maneuvering.

The filing targets Colorado laws that limit the size of ammunition magazines and expand background checks. The regulations passed the Legislature this spring and are set to take effect July 1.

It isn't yet clear whether the sheriffs' challenge will delay or jeopardize the laws. The filing, however, guarantees the renewal of a fierce debate over gun control.

Colorado lawmakers passed the restrictions in reaction to the shooting rampage at a suburban Denver movie theater last summer, where 12 people were killed and dozens more were wounded, and the massacre at an elementary school in Newtown, Conn.

The gun control debate was one of the most emotionally charged of the legislative session, with lengthy debates and national attention. President Barack Obama added to the attention on the Colorado Statehouse, as his administration unsuccessfully pushed Congress to enact similar gun controls.

Sheriffs' attorneys are considering whether to ask the court for a preliminary injunction, which would block the Colorado laws while the lawsuit moves forward.

The law enforcement community is divided on the issue. In contrast to the sheriffs, the Colorado Association of Chiefs of Police, which includes urban departments, supports the laws. The chiefs said the measures were "common-sense approaches" to protect the public "while not taking guns from law-abiding citizens in any way."

"These laws were not constructed haphazardly," said Democratic Sen. Mary Hodge, the sponsor of the magazine limit. "They were constructed to protect us from massacres like the ones we suffered in Aurora and Newtown."

Relatives of victims of the Colorado shooting criticized the sheriffs for filing the lawsuit and accused them of playing politics.

"As a parent who lost my son Alex at the Aurora theater shooting, I ask these people to put themselves in my place," Tom Sullivan said in a statement. "I do not understand why these politicians are picking guns over people."

Weld County Sheriff John Cooke said he and his colleagues were "not the ones playing politics with this."

"We believe that the Legislature were the ones who were playing politics," he said.

Gun control opponents say the language in the regulations is unclear and doesn't provide safeguards to prevent people from inadvertently breaking the laws.

Ammunition magazines, for example, are easily converted to larger sizes, which the bill bans. Gun rights advocates also say the law expanding background checks doesn't provide enough exemptions for temporary transfers and that people conducting private transactions will have a difficult time getting appropriate checks.

Lawmakers allowed several exemptions in the background check legislation, including transfers between immediate family members, shooting events and temporary transfers of up to 72 hours.

State officials, including Attorney General John Suthers, have worked to defend the intent of the laws. Suthers, a Republican responsible for defending the law against the legal challenge, issued a statement Friday giving guidance to law enforcement on how the magazine limit should be enforced.

He said magazine features "must be judged objectively" and that magazines that hold 15 rounds or fewer can't be defined as "large capacity" simply because it can be modified to include more.

The state has 30 days to respond to the lawsuit.

IRVING, Texas (AP) ? Ken Venturi was a 14-year-old with a camera trying to get a picture of Byron Nelson when he first met the golfer who would become a mentor and dear friend.

"He was, like, getting under the ropes a little bit, " Nelson's widow, Peggy, recalled Saturday of that moment during the 1946 San Francisco Open. "Byron said, 'Kid, could you move back under the ropes a little ways?' And Ken goes home and tells his mom, I met the greatest man today, Byron Nelson, and he spoke to me."

Venturi died Friday, in the middle of tournament week for the Byron Nelson Championship.

Venturi overcame dehydration to win the 1964 U.S. Open and spent 35 years in the booth for CBS Sports. He died at age 82, 11 days after being inducted into the World Golf Hall of Fame.

When CBS came on the air Saturday for third-round coverage of the Nelson, the first 15 minutes of the broadcast were a tribute to Venturi, who retired as the network's lead golf analyst in 2002.

Jim Nantz, whose 54th birthday was on the same day his longtime partner and friend died, said it was "not going to be easy" to broadcast this weekend.

The death of Venturi came a month and a day after broadcaster Pat Summerall died, also at age 82.

"It's been an unbelievable month to lose guys like that," said Lance Barrow, the longtime CBS producer for golf and NFL broadcasts. "It's a sad day."

Barrow likened Venturi's lengthy career as a broadcaster to Nelson's surely unmatchable record of 11 consecutive tournaments won.

"There will be no one ever in sports television again that will have the run that Ken Venturi had," Barrow said. "And will not come close to it, as an analyst in any sport, much less golf."

Tiger Woods issued a statement Saturday saying that Venturi's recent Hall of Fame induction was a "fitting tribute to a special person in our game."

"He was a good man and the voice of golf for so many years," said Woods, who isn't playing the Nelson this week. "He will be remembered for what he did on the golf course and for his personality in the broadcast booth. "

Ten years after Venturi was trying to get a picture of Nelson, he was a top amateur teamed with Harvie Ward against Nelson and Ben Hogan in what has since become known as "The Match."

Peggy Nelson said that was an amazing day for the players, and that Byron Nelson, who died in 2006 at age 94, and Venturi would sometimes talk about different shots each of them hit that day.

She characterized their friendship as precious and talked about what it was like "to see Byron's face light up whenever he thought of him" or when Venturi would call.

"I think that if Byron could have, he would have adopted Kenny," Peggy Nelson said. "Kenny's values were so strong and so wanting to help people as much as he could, because he knew that he was a very blessed man in the game of golf and that he was blessed to have so many friends like Byron and Mr. Hogan, and being close to both of them."

Barrow said Venturi tried to do everything Nelson taught him, from never charging for a golf lesson "because Byron Nelson said don't do that" to also checking in with the pro shop at a golf course before playing a round.

"This was a great thing that Byron Nelson told him, always go in and ask the pro who holds the course record. And if it's a pro, don't ever break it because that pro is there every day. You're only there for a few days," Barrow said. "That's what Venturi was like."

X-ray tomography on a living frog embryo

Classical X-ray radiographs provide information about internal, absorptive structures of organisms such as bones. Alternatively, X-rays can also image soft tissues throughout early embryonic development of vertebrates. Related to this, a new X-ray method was presented recently in a Nature article published by a German-American-Russian research team led by KIT. For periods of about two hours, time-lapse sequences of cellular resolution were obtained of three dimensional reconstructions showing developing embryos of the African clawed frog (Xenopus laevis). Instead of the absorption of X-rays, the method is based on their diffraction (DOI: 10.1038/nature12116).

"X-ray diffraction enables high-resolution imaging of soft tissues," explains Ralf Hofmann, one author of the study and physicist at KIT. "In our work, we did not only manage to resolve individual cells and parts of their structure, but we could also analyze single cell migration as well as the movement of cellular networks."

Using X-ray diffraction, similar tissues can be distinguished by minute variations of their refractive index. However, in contrast to classical absorption imaging, this does not require any contrast agent, and X-ray dose is profoundly reduced. The method is of particular advantage when probing sensitive tissues in living organisms, such as frog embryos. In their study, the researchers concentrated on the motion and shape changes of tissues, cavities, and single cells during the developmental milestone of gastrulation.

During gastrulation, germ layers are formed and organized in their proper locations. Thereby, an initially simple spherical ball of a few hundred cells turns into a complex, multilayered organism with differentiated tissues eventually turning into the nervous system, muscles, and internal organs. Quoting the renowned developmental biologist Lewis Wolpert: "it is not birth, marriage, or death, but gastrulation that is the most important event in your life."

"Employing X-rays, we were able to watch joint and individual cell movements during gastrulation," zoologist Jubin Kashef points out who is a co-author and head of a young investigator group at KIT. For the first time, it was appreciated how cells interact with each other in a living embryo and how regions void of cells form and disappear. "It is like the migration of peoples. Stimulated by the migration of individual cell groups, other cells join in. They form functional cellular networks, which adjust to their changing environment. During migration, cells specialize to form progenitor tissues of future organs, e.g. the brain or skin."

"It is fascinating to have digital capabilities to observe and analyze these processes in an individual living frog embryo," Hofmann and Kashef emphasize. "In this way, fundamental results are obtained." The new method not only reveals morphological and dynamic aspects of embryonic development but also provides insights into their underlying molecular biology obtained by comparing the development of wildtype embryos and morphant phenotypes. The African clawed frog (Xenopus laevis) is one of the most important model systems of developmental biology whose study is of relevance in understanding human embryogenesis and diseases. In future research, morphant phenotypes will be correlated with the targeted switch-offs of key proteins. For this purpose, the novel technique -- combining latest X-ray measurement technology with advanced image analysis and developmental biology -- will be established at the synchrotron radiation facilities ANKA in Karlsruhe and APS in Chicago for routine use by a broad community of scientific users.

In their study, KIT researchers, which were supported by biologists from Northwestern University, used coherent X-rays from the Advanced Photon Source of Argonne National Laboratory in Chicago. Prior to this investigation, the method had been developed at ANKA. During measurement, a coherent bundle of X-rays passes the nearly spherical 1-mm frog embryo, which rotates half way around its axis within 18 seconds. By variation of the irradiation direction, information on the three-dimensional (3D) structure is acquired. As X-rays pass through different types of tissues at variable speeds, diffraction occurs. In turn, this generates a characteristic intensity distribution by interference a certain distance behind the embryo. Within the 18 s of tomographic scan time, about 1200 images were recorded. Similar to digital photography, every image consists of several million pixels. From this vast amount of data, the three-dimensional structure and the development of the embryo over time is inferred at micrometer resolution. If this process is repeated at intervals of several minutes, the resulting sequence of 3D images reveals all gastrulation movements occurring inside the embryo. Image reconstruction and analysis algorithms for the here-employed X-ray phase-contrast microtomography were developed at ANKA.

Immediate results of this research are the discovery of new morphological structures and the clarification of fluid redistribution processes. Moreover, the locations of centers driving the migration of tissues and cells during gastrulation were determined by differential flow analysis.
